Licensing Requirements
The bring your own license ("BYOL") option allows IBM Customers, who have accepted the terms of the IBM SmartCloud Agreement, to access software Images in the IBM SmartCloud Enterprise offering provided the customer complies with the Image use requirements and has sufficient quantities of Passport Advantage (PA) software license entitlements and current PA Software Subscription and Support (S&S) entitlements (Entitlements). When a Customer uses Entitlements under this BYOL option in a Virtual Machine (Instance), or a Smart Cloud Application Service (SCAS) Virtual Application Pattern, those Entitlements are dedicated to that Instance or Pattern and Customer may not use such Entitlements outside the Instance or Pattern.
Software Image use requirements. Customer is responsible to:
- have accepted and remain in compliance with all terms of the applicable PA Program covering the Entitlements;
- have accepted and remain in compliance with the PA Attachment for Sub-Capacity Licensing Terms;
- maintain a written record of any use of Entitlements with the Services; and
- acquire and maintain current PA S&S for the Entitlements applied to the Instance or Pattern.
Notwithstanding the above, the Image Terms available for each Image and the IBM SmartCloud Agreement govern the use of an Image as part of the IBM Cloud.
Software Image Entitlement quantities
The Image description in the IBM SmartCloud Asset Catalog identifies the PA S&S part number and type of license metric (for example, number of PVUs, authorized users or application instances) applicable for each available BYOL Image. In addition, the corresponding PA License part number, PA S&S part number, and license metric use authorization for each Image is set forth in the table below by Image Name and Image Product Bundle ID Sub Component. Customers must initially obtain PA License Entitlements, which include the first twelve months of S&S, and thereafter obtain annual S&S Entitlements to the Program identified by the PA part number, sufficient to cover Customer's use of the corresponding Image on the IBM cloud. The number of Entitlements required for each Image is based on the license metric use authorization definition set forth in the License Information document for the corresponding Program, as modified in the License Metric Definitions section below, and, where applicable, the Table of PVUs Required per Instance.

License Metric Definitions
For each software Image, the license metric definition included in the Program License Information for the corresponding Program Part Number(s), per the Table above, governs the use of the software Image, except the words ‘Program’ and ‘Licensee’ used in the license metric definition must be substituted with the words ‘Image’ and ‘Customer’, respectively. The Program License Information is part of the IBM International Program License Agreement for the IBM Program.
For software Images which are licensed by 'PVU', the Table of PVUs Required per Instance (see webpage tab labeled 'Overview and Table of PVUs' above) lists the number of PVU Entitlements required per IBM SmartCloud Enterprise Instance.
For IBM Rational software Images which are licensed by 'Install' or 'Server', each 'Install' or 'Server’ entitles you to provision one Instance of the Image.
Record Keeping Requirements
Per the terms of the IBM SmartCloud Agreement, IBM Customers who choose to acquire PA Entitlements for the BYOL use option on the IBM SmartCloud Enterprise must have accepted and remain in compliance with the PA Attachment for Sub-capacity Licensing Terms (Sub-capacity Attachment), and maintain a written record of any use of Entitlements as set forth below:
For software Images licensed by PVU:
Sub-capacity Licensing is required for all software Images licensed by PVU
For information about Sub-capacity Licensing, including where to find the Sub-Capacity Attachment, how to accept sub-capacity terms, and other frequently asked questions, see the ‘Sub-capacity Licensing’ link on the right hand navigation bar. IBM SmartCloud Enterprise is an Eligible Virtualization Environment, but it is not yet supported by the IBM License Metric Tool (ILMT).
As described under Section 4 of the Sub-capacity Attachment, Customers agree to install and configure the most current version of ILMT…and generate Audit Reports in accordance with Sub-capacity Licensing terms, unless one of the four listed exceptions are met. If Customers meet one of these four exceptions, including when ILMT does not yet support the Eligible Virtualization Environment, Customers agree to manually prepare Audit Reports documenting the Virtualization Capacity by Eligible Product for the IBM SmartCloud Enterprise Virtualization Environment during each calendar or fiscal quarter. In any case, Audit Reports must be prepared as frequently as is required to maintain a history of increases to Virtualization Capacity, but not less than once per quarter, and must be maintained for at least two years and made available to IBM upon request.
For software Images licensed by non-PVU metrics:
The record keeping requirements described below are required for all software Images licensed by a license metric other than PVU
Customers are responsible to keep a Record of Use for all software Images provisioned with IBM SmartCloud Enterprise under the BYOL option. When a Customer uses Entitlements under this BYOL option in an Instance, those Entitlements are dedicated to that Image and Customer may not use such Entitlements outside the Instance.
This BYOL Record of Use must be updated as frequently as software Images are provisioned or de-provisioned for use in an Instance, but not less than once per quarter, and must be maintained for at least two years and made available to IBM upon request. The Record of Use must contain at least the following information, as provided in the example below:
- By Image, date Image was provisioned or de-provisioned for use in an Instance
- Name of software Image
- Corresponding PA Program part number
- Software Image license metric
- IBM SmartCloud Enterprise Instance type
- Entitlement quantity dedicated or removed
- Entitlement quantity balance by software Image
