This Privacy Statement covers the privacy practices that IBM employs when providing support, consulting, or hosting services (the "Services") to IBM clients through IBM’s Software products and Software-as-a-Service solutions (“Software Offerings”). IBM established this Privacy Statement to clarify IBM’s role as a processor where IBM processes services data on behalf of IBM clients through IBM’s Software Offerings. Services data (“Services Data”) is data that IBM is provided access to in connection with the Software Offerings and the related Services, such as data accessed through a Software-as-a-Service environment or data accessed through test, development and production environments. IBM treats Services Data in accordance with the terms and conditions set forth in the IBM agreement for the Software Offerings and related Services with the IBM client.
Services Data Use. Services Data may be accessed and used to fulfill the requirements specified in the IBM customer agreement for Services or Software Offerings. IBM technical staff may require periodic access to Services Data to monitor system performance, test systems and develop and implement upgrades to systems. Any temporary copies of Services Data created as a necessary part of this process are only maintained for time periods relevant to those purposes. IBM may also be required to provide personal information to comply with legally mandated reportings, disclosure or other legal process requirements. IBM reserves a limited right to disclose any personally identifiable information we receive if required by law or valid order of a court or other governmental authority, or if needed to protect the health and safety of IBM employees, a client's employees, or the general public.
IBM may transfer and access Services Data globally as required for the purposes specified above. If IBM hires subcontractors to assist in providing Services, their access to Services Data will be consistent with the terms of the relevant IBM customer agreement and this IBM Software Products and Software-as-a-Service Privacy Statement.
IBM does not use Services Data except as stated above or as provided in the relevant IBM customer agreement. IBM may process Services Data, but does not control an IBM client’s information collection or use practices for Services Data. If an IBM client provides any Services Data to IBM, the client is responsible for providing any notices and/or obtaining any consents necessary for IBM to access and use Services Data as specified in this statement and the IBM customer agreement.
IBM's access to Services Data is based on job role/responsibility. Services Data residing in IBM hosted systems is controlled via an access control list (ACL) mechanism, as well as the use of an account management framework. As IBM clients control access to Services Data by its end-users, end-users should direct any requests related to their personal information to IBM clients.
Certain IBM Software Offerings may provide IBM clients the ability to collect personal information, via cookies and other technologies, from their end-users. IBM clients should seek their own legal advice about any laws applicable to their collection of such information, so that IBM clients can be sure that they are complying with those laws, including providing any required notices and obtaining any required consents.
Modifications to Statement. IBM reserves the right to modify or supplement this IBM Software Product and Software-as-a-Service Privacy Statement at any time. The most recent version of the IBM Software Product and Software-as-a-Service Privacy Statement will appear on this website with the relevant modification date.
