Overview

Lotus® Sametime® is IBM's market-leading platform for instant collaboration. More than 9 million people use it every day to share information, make faster decisions, and work together in real time. Warranty: This program has warranty for a minimum of one year from acquisition from IBM or authorized Business Partner. The warranty provided to the customer, for at least one year from acquisition, is access to databases (read Web sites) for program information, FAQs, including any known fixes to defects, which the customer can download or obtain otherwise and install at their leisure.

Program technical support: Technical support of a program product will be available for a minimum of three years from the general availability date, as long as your Software Maintenance is in effect. This technical support allows you to obtain assistance (via telephone or electronic means) from IBM for product-specific, task-oriented questions regarding the installation and operation of the program product. Software Maintenance also provides you with access to updates, releases, and versions of the program. Customers will be notified, via announcement letter, of discontinuance of support with 12 months' notice. If you require additional technical support from IBM, including an extension of support beyond the discontinuance date, contact your IBM representative or Business Partner. This extension may be available for a fee.

Money-back guarantee: If for any reason you are dissatisfied with the program, return it within 30 days from the invoice date to the party (either IBM or its reseller) from whom you acquired it for a refund. This applies only to your first acquisition of the program.

Authorization for use on home/portable computer

  • "1" means that the Program may be stored on the primary machine and another machine, provided that the program is not in active use on both machines at the same time.
  • "2" means that you may not copy and use this program on another computer without paying additional license fees.

Program-unique terms

Sametime license

You must acquire a Sametime Per User license for each of your employees and independent contractors who access the Sametime Server or any applications hosted on the Sametime Server. Your acquisition of Sametime Per User licenses as set forth above entitles you to install an equal number of copies of the Sametime Client, in addition to as many Sametime Servers as are reasonably necessary to provide the foregoing access. Your use of Sametime requires that you install Lotus Domino. If you do not yet have Lotus Domino installed in your enterprise pursuant to separate licenses with IBM, you may install on the same machine copies of Lotus Domino equal to the number of copies of Sametime Servers installed. Lotus Domino may be accompanied by a separate license. Notwithstanding anything to the contrary in these separate license terms, you may use Lotus Domino solely and exclusively in conjunction with your use of Sametime, and for no other purpose. For users who are not employees or independent contractors of your enterprise, you must acquire either a Sametime Per User License or a Sametime Extranet Server License; however, for users who are employees or independent contractors of your enterprise, your sole licensing option is to purchase one Sametime Per User License for each such employee or independent contractor. You are not permitted to use Sametime or Lotus Domino in any manner to provide hosting services to any Third Parties.

Sametime Extranet Server

For access to the Sametime Server or any applications hosted on the Sametime server by users who are neither employees nor independent contractors of your enterprise ("Third Parties"), you may acquire a Sametime Extranet Server license. You must acquire one copy of the Sametime Extranet Server for each central processing unit on the machine on which you are authorized to install and use the Sametime Extranet Server. Your use of Sametime requires that you install Lotus Domino. If you do not yet have Lotus Domino installed in your enterprise pursuant to separate licenses with IBM, you may install on the same machine copies of Lotus Domino equal to the number of copies of Sametime Servers installed. Lotus Domino may be accompanied by a separate license. Notwithstanding anything to the contrary in these separate license terms, you may use Lotus Domino solely and exclusively in conjunction with your use of Sametime, and for no other purpose. Employees and independent contractors of your enterprise who have acquired a Sametime Per User license may access the Sametime Extranet Server or any applications hosted on the Sametime Extranet Server. You are not permitted to use Sametime or Lotus Domino in any manner to provide hosting services to any Third Parties.

Software Maintenance applies: Yes

Software Maintenance, previously referred to as Subscription and Technical Support, is now included in the Passport Advantage Agreement. Installation and technical support for the product announced in this letter is provided by the Software Maintenance offering of the IBM International Passport Advantage Agreement. This fee service enhances customer productivity by providing voice and/or electronic access into the IBM support organizations.

IBM includes one year of Software Maintenance with the initial license acquisition of each program acquired. The initial period of Software Maintenance can be extended by the purchase of a renewal option that is available.

While your Software Maintenance is in effect: IBM provides you assistance for your (1) routine, short duration installation and usage (how-to) questions; and (2) code-related questions. IBM provides assistance via telephone and, if available, electronic access, only to your information systems (IS) technical support personnel during the normal business hours (published prime shift hours) of your IBM support center. (This assistance is not available to your end users.) IBM provides Severity 1 assistance 24 hours a day, every day of the year. For additional details, consult your IBM Software Support Guide at:

Software Maintenance does not include assistance for (1) the design and development of applications, (2) your use of programs in other than their specified operating environment, or (3) failures caused by products for which IBM is not responsible under this agreement.
