Managing electronically stored information (ESI) of any sort, e-mail, non-e-mail, is critical in responding to electronic discovery requests, whether for legal proceedings, investigations, audit, or corporate level information inquiries. IBM InfoSphere eDiscovery Manager V2.1.1 and IBM InfoSphere eDiscovery Analyzer V2.1.1 are enterprise level Electronic Discovery (eDiscovery) tools, enabling organizations to gain agility in responding to eDiscovery requests with a lower cost in house, Enterprise Content Management (ECM) platform-based approach.

New capabilities

  • Search, cull, hold, and export case-relevant content, e-mail and non-e-mail, that is brought into content platform, with easy-to-use Web-based user interface.
  • Schedule recurring searches for the same matter to effectively manage it over the life of the matter.
  • Manage holds on matter relevant content with out-of-the-box native hold capability.
  • Audit tracking of all the operations from searching, culling, holding to export.
  • Export case-relevant content in EDRM XML format (in addition to previously supported Microsoft® Exchange and Lotus® Domino® formats) for further detailed review.

By adding IBM InfoSphere eDiscovery Analyzer, you can perform detailed analytics on the case content to:

  • Gain early insight into a case, identify key concepts, phrases, understand key facts, communication threads, locate key pieces of evidence, identify key witnesses, and form early case strategies.
  • Analyze case content using Saved Search Categories and Active Links to related content categories to quickly cross-reference related case material.
  • Run query set reports to gain a clear view of available matters to effectively negotiate queries and term lists during the meet and confer stage.
  • Visualize sender/recipient relationships to gain better understanding of communication traffic patterns relative to the matter.
  • Quickly identify irrelevant, non-responsive, and privileged content to reduce matter to a much smaller and relevant data set.
  • Flag, organize, and prioritize documents and e-mails for review, and define the appropriate eDiscovery response strategy. You can add reviewer notes on content as it is being flagged for further analysis.

Electronic Discovery (eDiscovery) is the process of identifying, locating, securing, and producing information for the purpose of handling regulatory matters, internal or governmental investigations, employee disputes, corporate governance, operational control, and evidence finding for utilization in the legal process. The eDiscovery process defines what Electronically Stored Information (ESI) is needed, how they are collected, processed, reviewed, and eventually produced or shared with the requesting party or parties.

IBM InfoSphere eDiscovery Manager V2.1.1 is the cornerstone of IBM's proactive, platform-based eDiscovery solution enabling authorized users to search, cull, hold, and export case-relevant content leveraging IBM Content Manager or IBM FileNet® Content Manager repositories as the base platform. ESI can be brought into these repositories via IBM Content Collector (previously known as IBM CommonStore or IBM eMail Manager), IBM FileNet Capture, or customer line-of-business applications. eDiscovery Manager can be used to create new cases or work on existing cases and save searches to share with authorized users. It keeps audit track and chain of custody of all the processes it manages.

IBM InfoSphere eDiscovery Manager V2.1.1 provides capabilities to bring eDiscovery processes in house for search, cull, hold, and export ESI enabling corporations to take control over corporate content reducing overall eDiscovery costs. It is optimized and designed for working on high volume content, including e-mail and non-e-mail content types with a rich set of functionality.

IBM InfoSphere eDiscovery Manager V2.1.1 provides:

  • Case insensitive, Boolean, proximity, fuzzy and stemmed, wildcard search on metadata, ECM documents, image metadata, e-mail message body, and attachments.
  • Ability to save and reuse search terms, associate searches with existing or new cases, permitting other users to perform searches based on security profiles to increase user productivity.
  • Ability to schedule the searches to allow ongoing automated collection and holds which eliminates the need for user executed recurring searches.
  • Browser-based content viewing capability with highlighting of search terms allowing users to quickly and efficiently locate and preview the context of ESI for relevance.
  • Automated hold capability to suspend the normal scheduled disposition of content once they are deposited into a litigation vault to avoid spoliation sanctions, accidental deletions, as well as facilitates implementing the duty to preserve litigation-relevant content. It also delivers out-of-the-box integration with IBM corporate enterprise-wide records management systems to enforce common taxonomy and retention schedules.
  • Chain of custody, audit, and reporting capability to demonstrate authenticity and meet chain of custody requirements, at a case level, by maintaining a full audit trail that can be exported and used in courts, increasing defensibility of the ESI evidence exported.
  • Export capability to export culled content set in their native formats (.nsf for Lotus Domino, .msg for Exchange Server, EDRM XML for non-e-mail content) for further linear attorney review.
  • Fully configurable export pluggable architecture for partners to plug in custom export actions.
  • Fully supported API set for further application integration.

IBM InfoSphere eDiscovery Analyzer V2.1.1 provides capabilities to:

  • Process IBM InfoSphere eDiscovery Manager case folders and index them for further analysis.
  • Allow users to narrow and filter the case results by searching for specific terms.
  • Provide legal analysts, investigators, and authorized corporate users the ability to utilize the timeline and sender/recipient visualization mechanisms to evaluate the results for the periods of time associated with the case or a particular search.
  • Allow for analysis of case contents using Saved Search Categories and Active Links to related content categories to quickly cross-reference related case material.
  • Provide investigative assistance to users who can also use the facet analysis to determine phrases, recipients, senders, people, companies, and flags to perform even more complete analysis.
  • Provide users the ability to visualize sender/recipient relationships to gain better understanding of communication traffic patterns relative to the matter.
  • Allow the user to flag individual documents or e-mails or groups of documents and e-mails according to their pertinence to the case.
  • Cull out extraneous or irrelevant correspondence that lets the organization significantly reduce redundant or unnecessary ESI turned over for further review, generally reducing the associated cost of attorney review.
  • Can commit back to IBM InfoSphere eDiscovery Manager for review, after first pass review or pre-analysis is complete.

Together, InfoSphere eDiscovery Manager and InfoSphere eDiscovery Analyzer lets you to gain agility in responding to litigation, investigations, audit, and information inquiries with:

  • High volume, high-scale platform based on IBM Content Manager or IBM FileNet Content Manager, preparing responsive content set with reduced processing time.
  • User interface optimized to support high-scale operations without requiring extensive end user training.
  • A zero footprint Web 2.0 and AJAX based client allowing users to launch it by simply pointing the browser to a Web address. This requires minimal user training.
  • Globalization support for group 1, and selected group 2 and group 3 languages allowing international customers to perform discovery requests in the supported language of their choice.
  • User friendly, easy-to-deploy out-of-the-box installation program increasing its consumability.
  • A lower cost in house approach.

Hardware requirements

IBM InfoSphere eDiscovery Manager requires the following systems.

  • Server: 4-way recommended; 2-way minimum
  • Processor:
    • AIX®: POWER® processor
    • Microsoft Windows®: x86 processor
  • RAM: 8 GB recommended; 4 GB minimum

IBM InfoSphere eDiscovery Analyzer requires one of the following hardware.

Memory and processors

The following table specifies basic server processor and RAM requirements for an eDiscovery Analyzer system. For multiple server configurations, ensure that you have the same processor and memory model on all eDiscovery Analyzer servers.

Disk space

The minimum disk space required to install eDiscovery Analyzer is 1 GB, plus 1 GB of temporary space.

The disk space requirements for running the system can vary and depend on the average document size, the number of documents in the case, and number of cases.

For a multiple node configuration, the disk space requirements affect the main node in the eDiscovery Analyzer setup, since all the case-related data is stored on the main node. On the helper nodes, there is no specific disk requirement other than the minimum disk requirement to install.

The following disk space requirements are suggested for the main eDiscovery Analyzer node for an average use case.

Charge metrics definitions

IBM InfoSphere eDiscovery Manager and IBM InfoSphere eDiscovery Analyzer have a new structure for licensing and pricing designed for clarity, simplicity, and unity with other products in the IBM Enterprise Content Management portfolio.

User Value Units (UVU)

Three types of UVU are available:

  1. Authorized (AUVU): For selective licensing of users who are internal to the organization. This replaces Authorized User licensing. The number of UVUs (Authorized UVUs) you require will be based on the number of authorized users that may access the program.
  2. External (XUVU): For licensing of users who are external to the organization. The number of UVUs (External UVUs) you require will be based on the number of external users that may access the program.
  3. Employee (EUVU): For collectively licensing all users who are internal to the organization. The number of UVUs (Employee UVUs) you require will be based on the number of employee users that may access the program.

IBM InfoSphere eDiscovery Manager

User means an individual (named or unnamed) within or outside of your enterprise permitted to access the program or any program component in any manner directly or indirectly (for instance, via a multiplexing program, device, or application server) through any means, and in addition, each and every additional specific individual (named or unnamed) within or outside your enterprise, whose e-mail content may be accessed or searched, or is authorized by you to be accessed or searched, at any time by the program, either directly or indirectly (via a multiplexing program, device, or application server) through any means. A single individual permitted to access the program or any component, and whose e-mail content will be accessed or searched or is authorized to be accessed or searched, will only be counted as a single authorized user.

IBM InfoSphere eDiscovery Analyzer

User means an individual (named or unnamed) within or outside of your enterprise permitted to access the program or any program component in any manner directly or indirectly (for instance, via a multiplexing program, device, or application server) through any means, and in addition, each and every additional specific individual (named or unnamed) within or outside your enterprise, whose e-mail content will be analyzed, or is authorized by you to be analyzed, at any time by the program, either directly or indirectly (via a multiplexing program, device, or application server) through any means. A single individual permitted to access the program or any component and whose e-mail content will be analyzed or is authorized to be analyzed will only be counted as a single authorized user.

Product pricing

Each product has a fixed price per UVU. Customers license the appropriate number of UVUs to provide access to a corresponding user population.

Cumulative volume discounting

As the user quantity increases, the number of UVUs increase albeit at a slower rate. Value Unit license conversion tables establish the required number of UVUs for a specified number of users.

Volume discounting examples:

  • 100 authorized users require 85 AUVUs
  • 1,000 authorized users require 600 AUVUs
  • 5,000 authorized users require 2,500 AUVUs

Content Manager configuration example:

  • Content Manager AUVU price = $Y per AUVU
  • 5,000 authorized users require 2,500 AUVUs
  • Total price = $Y x 2,500

The terms and conditions that govern any transaction with IBM are contained in the applicable contract documents such as the IBM International Program License Agreement, IBM International Passport Advantage Agreement, and the IBM Agreement for Acquisition of Software Maintenance.

Licensing

IBM International Program License Agreement including the License Information document and Proof of Entitlement (PoE) govern your use of the program. PoEs are required for all authorized use.

Part number products only, offered outside of Passport Advantage, where applicable, are license only and do not include Software Maintenance.

Warranty

IBM warrants that when the program is used in the specified operating environment, it will conform to its specifications. The warranty applies only to the unmodified portion of the program. IBM does not warrant uninterrupted or error-free operation of the program or that IBM will correct all program defects. You are responsible for the results obtained from the use of the program.

IBM provides you with access to IBM databases containing information on known program defects, defect corrections, restrictions, and bypasses at no additional charge. Consult the IBM Software Support Handbook for further information at

IBM will maintain this information for at least one year after the original licensee acquires the program (warranty period).

Money-back guarantee

If for any reason you are dissatisfied with the program and you are the original licensee, you may obtain a refund of the amount you paid for it, if within 30 days of your invoice date you return the program and its PoE to the party from whom you obtained it. If you downloaded the program, you may contact the party from whom you acquired it for instructions on how to obtain the refund.

For programs acquired under the IBM International Passport Advantage Agreement, this term applies only to your first acquisition of the program.

Authorization for use on home/portable computer

The program may be stored on the primary machine and another machine, provided that the program is not in active use on both machines at the same time. You may not copy and use this program on another computer without paying additional license fees.

Software Subscription and Support (Software Maintenance)

These products are licensed under the IBM Program License Agreement (IPLA), and the associated Agreement for Acquisition of Software Maintenance, which provide for support with ongoing access to releases and versions of the program.

These programs have a one-time license charge for use of the program and an annual renewable charge for the enhanced support that includes telephone assistance (voice support for defects during normal business hours), as well as access to updates, releases, and versions of the program as long as support is in effect.
