Electronic Discovery (eDiscovery) is the process of identifying, locating, securing, and producing information for the purpose of handling regulatory matters, internal or governmental investigations, employee disputes, corporate governance, operational control, and evidence finding for utilization in the legal process. The eDiscovery process defines what documents are needed, how they are collected, processed, reviewed, and eventually packaged to be presented to external or opposing counsel.
IBM eDiscovery Manager V2.1 is an eDiscovery tool for e-mail that is the cornerstone of IBM's proactive, platform-based eDiscovery solution enabling authorized users to search, cull, hold, and export case-relevant e-mail from IBM Content Manager or IBM FileNet Content Manager e-mail archives created by IBM CommonStore or IBM E-mail Manager, with an easy-to-use Web-based UI. It can be used to create new cases or work on existing cases and save searches to share with authorized users. It keeps audit track and chain of custody of all the processes it manages. If you use eDiscovery Manager, you can gain agility in responding to litigation with a lower cost in house approach than fully outsourcing the e-mail eDiscovery process.
eDiscovery Manager provides capabilities to:
- Bring e-mail eDiscovery process in house for search, cull, hold, and export
e-mail enabling corporations to take control over e-mail reducing overall
eDiscovery costs. It is optimized and designed for working on high volume
e-mail with high performance and a rich set of functionality:
- eDiscovery Manager provides case insensitive, boolean, proximity, fuzzy and stemmed, wildcard search on metadata, message body, attachments for e-mails for customers who prefer IBM Content Manager as a litigation vault. E-mails are brought into IBM Content Manager via IBM CommonStore.
- eDiscovery Manager provides Boolean and wildcard search on metadata for customers who prefer IBM FileNet P8 as a litigation vault. E-mails are brought into IBM FileNet Content Manager via IBM FileNet Email Manager.
- Ability to save and reuse search terms, associate searches with existing or new cases, permit other users to perform searches based on security profiles to increase user productivity.
- Browser-based e-mail viewing capability with highlighting of search terms allowing users to quickly and efficiently locate and preview the context of e-mail for relevance.
- Automated hold capability to suspend the normal scheduled disposition of e-mails once they are deposited into a litigation vault to avoid spoliation sanctions, accidental deletions, and facilitates implementing the duty to preserve litigation-relevant content. It also delivers out-of-the-box integration with IBM corporate enterprise-wide records management systems to enforce common taxonomy and retention schedules.
- Chain of custody, audit, and reporting capability to demonstrate authenticity and meet chain of custody requirements, at a case level, by maintaining a full audit trail that can be exported and used in courts, increasing defensibility of the e-mail evidence exported.
- Export capability to export culled e-mail set in native formats (.nsf for Lotus Domino, .msg for Exchange Server) for litigation document review.
- Gain agility in responding to litigation with:
- High volume, high-scale litigation vault (IBM Content Manager or IBM FileNet Content Manager), preparing responsive e-mail set with reduced processing time.
- User interface optimized for high performance retrieval while minimizing mouse clicks, keys strokes, and user interactions.
- A zero footprint Web 2.0 and AJAX-based client allowing users to launch it by simply pointing the browser to a URL so it requires minimal user training.
- Globalization Support for group 1, and selected group 2 and group 3 languages allowing international customers to perform discovery requests in the supported language of their choice.
- User friendly installation program increasing its consumability, easy to deploy out of the box.
- A lower-cost in house approach than fully outsourcing the eDiscovery process
IBM eDiscovery Manager is a follow on of IBM eMail Search for CommonStore. Customers with IBM eMail Search for CommonStore, who are under active maintenance, are entitled to eDiscovery Manager.

You may aggregate the capacity for all the processors the product is operated on to achieve a more economic price. This will result in a single Proof of Entitlement (PoE). It is your responsibility to manage the distribution of Value Units within the limits of the entitlement of the product license.
Subscription and Support must cover the same capacity as the product license entitlement. Subscription and Support will be available in the country in which the agreement is made.

Charge metrics definitions
User Value Unit (UVU)
UVU is the metric by which this program is licensed. UVU entitlements are based on the number of users for the given program. A PoE must be obtained for the appropriate number of UVUs required for your environment as defined by the specific program terms. The UVU entitlements are specific to the program and may not be exchanged, interchanged, or aggregated with UVU entitlements of another software program. UVU licensing offers price benefits for customers by enabling a lower cost of incremental growth of resources. To understand these benefits of UVU licensing, and to determine how many UVUs to obtain for the program, please contact your IBM representative.
Custodian User means one and only one specific individual (named or unnamed) within or outside your enterprise, whose e-mail content will be searched, or is authorized by you to be searched, at any time by the program, either directly or indirectly (via a multiplexing program, device, or application server) through any means.
Enterprise means any legal entity that at all times (i) you own or have under your common control by a factor of 50% or more and (ii) that is the legal entity that is authorized to execute and administer this agreement on behalf of the enterprise. For the purposes of any enterprise license granted under this agreement, Enterprise will exclude (i) any new entity acquired by virtue of merger or acquisition after the effective date of this agreement, and (ii) any entity that, at any time during the term of this agreement, is sold, spun off, liquidated, or that otherwise ceases to satisfy the elements of the definition of enterprise set forth above.
License means each license granted under this agreement by IBM to you, to use the program as listed on a PoE.
General charge terms
UVU entitlements are based on the number of users for the given program. A PoE must be obtained for the appropriate number of UVU required for your environment as defined by the specific program terms. The UVU entitlements are specific to a program and may not be exchanged, interchanged, or aggregated with UVU entitlements of another program. To determine the number of UVU license entitlements required, refer to the UVU license conversion table.
In addition, if you are licensed on a UVU basis and the program you are licensed to use is incremented on a Custodian basis (CUVU), the following will apply. Each Custodian User licensed under a Custodian UVU entitlement, as indicated in the applicable PoE, may access that program or any component of that program up to the authorized level. At all times, the number of Custodian Users accessing the program or any component of the program in any manner, directly or indirectly or through any other means, must not exceed your entitlement to use the program, as indicated on the applicable PoEs.
