Overview

MQSeries® Family

IBM's new framework of MQSeries products addresses integration from a business as well as an information technology (IT) perspective. The product family offers information systems that support the way you work, that fit in with your business processes and workflow, and that deliver real business advantages.

The family of Business Integration solutions, based around IBM's award-winning MQSeries software, consists of:

  • MQSeries: The undisputed leader in message-oriented middleware for message-based applications. The base MQSeries product totally and reliably connects any application, or system, to any other.
  • MQSeries Integrator: Powerful message brokering that centralizes knowledge of the enterprise (like business rules and application data formats) in a central hub. It makes it much quicker and simpler to distribute data relating to business events, and integrate applications to build new business.
  • MQSeries Workflow: Aligns and integrates your organization's resources and capabilities with your business strategies, accelerating process flow, cutting costs, eliminating errors and improving workgroup productivity.

MQSeries Version 5.1

The new release of the MQSeries products, at Version 5.1, for AIX®, Sun Solaris, HP-UX, Windows NT® and OS/2® Warp offers the benefits of new dynamic workload distribution technology consistent across MVS™ and key distributed platforms. Also available for MQSeries Version 5 products are Publish/Subscribe facilities enabling selective choice for receipt of information.

These products include the Candle Command Center Admin Pac for MQSeries, licensed under Candle's terms and conditions.

Service is being extended to January 31, 2001, for the MQSeries for Windows™, V2.0 and V2.1, products.

MQSeries Version 5.1

Scalability Improvements

  • Exploitation of dynamic workload distribution technology — MQSeries is now easier to deploy across multiple nodes and benefits from load balancing across multiple processors.
  • OS/2 SMP for high memory — decreases the limitations associated with OS/2 shared memory allowing more clients and applications to run alongside DB2®/Comms and other high memory entities.
  • Increased queue size now 2 Gb — improves message throughput and allows increased message-holding memory capabilities.
  • Multi-threaded channels support — increases the number of clients capable of running against a Sun, AIX, or HP platform.

Performance Improvements

  • Dynamic workload distribution support provides efficient use of available resources, maximizing efficiency of closely linked processors.
  • I/O avoidance when MQGET waiting minimizes disk access.
  • Multi-threaded agent process enables more efficient use of resource. Multiple application processes can run in parallel, improving throughput.

Interoperability

  • Workload balancing with dynamic workload distribution support.
  • Integration of technology links Lotus Notes® and Domino.Connect™ to the wider enterprise via MQSeries LotusScript® Extension, on MQSeries for Windows NT.
  • Supports latest operating systems.
  • Currency enhancements to align with leading edge environments.

Cost Effective Improvements

  • Automated administration provides reductions in costs associated with training and skills required in administering a cluster environment.
  • Recovery function within a dynamic workload distribution environment, or cluster, enables seamless failover and continued operation at minimal effort and cost to the systems administrator.
  • Improved application development features for administration applications.

Usability Enhancements

  • Faster setup and easier management of the environment.
  • Compatible to Microsoft™ Directions for the MQSeries for Windows NT product.

Availability Enhancement

  • Continued availability and workload balancing, in the event of a processor or communications failure, through exploitation of dynamic workload distribution technology.

Publish/Subscribe: This MQSeries release introduces standard implementation of a new messaging model for applications-Publish and Subscribe, sometimes known as Event Services. It enables users to register interest in particular sets of information and then to receive such information when it becomes available. The Publish/Subscribe model provides direction in that the publisher of data need have no prior knowledge about the receivers of such data and vice versa. Subject to authorities, publishers may start or cease, and applications may create, vary or delete subscriptions without the need for administrative action. Publish/Subscribe exploits the strengths of the existing MQSeries infrastructure. Applications can combine Publish/Subscribe with other messaging calls and other subsystems (such as, databases) and have the same choice of qualities of service (non-persistent, persistent or transactional) as in other MQSeries applications.

This facility is available for MQSeries on the AIX, Sun Solaris, HP-UX and Windows NT platforms.

Tivoli Ready: Management of MQSeries, using the Tivoli Ready component, provides the following benefits:

  • The automatic discovery of queue managers. Knowing what resources are being used in a complex, distributed environment is an important component of managing MQSeries. With the auto-discovery feature, queue managers are detected and reported to the Tivoli Global Enterprise Manager (GEM) console where they are incorporated into a topology map of the environment.
  • The automation of responses to events and alerts such as the restarting of a failed channel are supported by the Tivoli Event Console. In addition, because events from system resources, such as operating systems, databases, and other middleware products are also processed by the Tivoli Event Console, MQSeries events can be correlated with events from its supporting infrastructure and surrounding environment. This provides administrators with the complete view and control of the MQSeries application environments required to maximize its availability.

Tivoli Manager for MQSeries provides additional MQSeries management capabilities including:

  • MQSeries component distribution
  • Additional performance and availability monitoring
  • Topology maps
  • Comprehensive library of user-friendly command interfaces for MQSeries

Candle Command Center Admin Pac for MQSeries: Included with the MQSeries software package is a selection of Candle solutions for testing MQSeries applications, configuring MQSeries networks, and managing MQ™-based computing enterprises.

The Candle Command Center Admin Pac for MQSeries contains:

  • A fully functioning version of PQEdit, an application testing tool that helps speed applications to production.
  • A single-user version of Candle Command Center for MQSeries Configuration, a product that simplifies configuration and management of MQSeries networks.
  • A customized version of Candle Command Center for MQSeries, an availability management solution that generates monitoring reports on MQSeries networks and applications.

System Requirements:

  • Candle Management Workstation (CMW) is the main graphical user interface (GUI) and requires Win32 system (NT or Win95/Win98).
  • Candle Management Server (CMS) is the server component. You need one of these to use the monitoring or configuration features. It runs on NT, AIX, HP/UX or OS/390®.
  • Agents: These are the platform-specific interfaces (NT, Win95, AIX, OS/2, HP/UX, Solaris, OS/390).
  • PQEdit: (Standalone tool for browsing/editing queues); (NT, Win95, AIX, OS/2, HP/UX, Solaris, OS/390 — not OS/400®). Neither CMW nor CMS actually require MQSeries to be installed on the same machine as they use TCP/IP or SNA for communication.

MQSeries Integrator: MQSeries Integrator software enables integration of applications and systems into robust, flexible, and scalable information networks. Based upon MQSeries messaging and queuing capabilities, MQSeries Integrator features intelligent message routing that directs data according to conditions set by the business, and message formatting enables applications to exchange information. Its GUI allows users to perform integration tasks quickly and easily. Preconfigured templates for major packaged applications and e-business extensions will also be available. This product is now available under IBM terms and conditions worldwide. IBM will continue to add Business Integration capabilities to MQSeries Integrator and provide a route for IBM Business Partners to offer additional functionality.

MQSeries Workflow: MQSeries Workflow is a workflow management middleware offering that automates workflow between applications. It automates business processes involving people and applications to give organizations more control of their business activities. MQSeries Workflow helps you in daily business operations, planning, and management, to align and integrate resources and applications, to improve efficiency, and to gain higher market share. In addition, it enables the design of applications tailored to your business needs.

Year 2000

These products are Year 2000 ready. When used in accordance with their associated documentation, they are capable of correctly processing, providing, and/or receiving date data within and between the twentieth and twenty-first centuries, provided that all products (for example, hardware, software, and firmware) used with the products properly exchange accurate date data with them.

The service end date for these Year 2000 ready products is December 31, 2001.

Product Positioning

MQSeries Family

The family of products based on IBM's industry-leading MQSeries software helps companies address business integration issues quickly and economically, making them more agile, customer oriented and competitive.

The MQSeries family allows companies to maximize e-business opportunities by leveraging existing resources to improve speed-to-market and anticipate IT changes as their business changes.

IBM Business Integration consists of three offerings under the MQSeries brand which are designed to complement each other and be used together:

  • MQSeries for secure and reliable communication of application messages over a wide range of platforms.
  • MQSeries Integrator for transformation and routing of application message contents as transmitted via MQSeries. It is optimized for high-volume, in-storage transformation of messages. It is very useful in environments where many applications exchange information, each requiring slightly different message formats.
  • MQSeries Workflow for integration of application components via predefined workflow models is a more structured,though complex, approach to integration. This is less about message transformation and routing between applications, but more about the integration of applications for different tasks, into a cohesive business process. MQSeries Workflow can automate the execution of activities, whether manual human tasks, user input into an application, or automatic flow of information into a backend transaction. It maintains state information about the process, for routing decisions, monitoring and auditing purposes.

MQSeries Integrator and MQSeries Workflow rely on MQSeries.

MQSeries Integrator intercepts MQSeries messages transforming and routing the message contents based upon information stored in a rules database.

MQSeries Workflow uses MQSeries messaging for the communication between the MQSeries Workflow clients and servers.

Statement of Direction

  • IBM intends to further enhance its MQSeries V5.1 product by adding Informix support.
  • IBM MQSeries for AS/400® will be enhanced to provide functional parity with the other MQSeries V5.1 products on UNIX® platforms. This will increase compatibility between MQSeries on the AS/400 platform and these other platforms.

MQSeries for AIX, V5.1

Hardware Requirements: Any Year 2000 compliant RS/6000™ hardware that is explicitly compatible and fully capable of running the specified operating system, all the corresponding supporting software shown below, and any associated applications unmodified. Responsibility to provide statement of full compatibility between machines lies with the original equipment provider.

Any hardware capable of running other trademarked AIX systems from IBM or other vendors that have passed a set of certification tests for compliance with the AIX application binary and programming interfaces. For further details on the AIX Multiple Vendor Program (MVP), refer to:

Connectivity: Network protocols supported are SNA LU6.2 and TCP/IP.

Software Requirements

  • AIX V4.2 with relevant Year 2000 fixes
  • AIX V4.3 with relevant Year 2000 fixes

Software requirements are identical for server and client AIX environments unless otherwise stated.

Responsibility to provide statement of full compatibility between machines lies with the original equipment provider.

Connectivity: Network protocols supported are SNA LU6.2 and TCP/IP.

Software Requirements: Software requirements are identical for server and client HP environments unless otherwise stated.

  • HP-UX V10.20 with relevant Year 2000 fixes
  • HP-UX V11.0 with relevant Year 2000 fixes

MQSeries Clients: Client code for AIX, DOS, HP-UX, OS/2, Sun Solaris, Windows NT, Windows 3.1, Windows 95 and Java are supplied with the product. Client software provides a remote interface to a MQSeries server. Client support does not result in distributed coordination of units of work. The Windows 3.1 client can operate under Windows 3.1 or Windows 95.

DCE Supported

  • The HP DCE/9000 version appropriate for the level of HP-UX operating system in use, provided this is compatible with DCE V1.4.1 as supplied for HP-UX V10.10. This must be the US version supporting DES encryption for users to run the MQ-supplied DCE send, receive, or message exits.

    Note: It is critical to apply HP service. Patches are listed in the Release Note delivered with the HP DCE software. However, for the latest information, contact the local HP support center.

    DCE names and security modules for MQSeries are provided as part of the MQSeries for HP-UX product.

MQSeries for Sun Solaris, V5.1

Hardware Requirements: Any Year 2000 compliant Sun Microsystems SPARC hardware that is explicitly compatible and fully capable of running the specified operating system, all the corresponding supporting software shown below, and any associated applications unmodified. Responsibility to provide statement of full compatibility between machines lies with the original equipment provider.

Note: A minimum system disk space of 25 Mb required. An additional 25 Mb of disk space is required if DynaText is to be installed.

Connectivity: Network protocols supported are SNA LU6.2 and TCP/IP.

Software Requirements: Software requirements are identical for server and client Sun Solaris environments unless otherwise stated.

  • Sun Solaris V2.6 with patches 105210-13 and 105568-10
  • Sun Solaris 7

It is recommended that the latest levels of all relevant patches to the base operating system are installed.

Note: Solaris systems from other manufacturers are not supported.

MQSeries Clients: Client code for AIX, DOS, HP-UX, OS/2, Sun Solaris, Windows NT, Windows 3.1, Windows 95 and 98, and Java are supplied with the product. Client software provides a remote interface to a MQSeries server. Client support does not result in distributed coordination of units of work. MQSeries Pricing: The price model is structured over seven Processor Group tiers. In general, the tiers are linked to numbers of processors per machine or node on which MQSeries program(s) will run, as shown in the list GC34-5265. The tiers relate to a required number of capacity units. Additional capacity units are required as you move to larger systems, or add new systems, to accommodate your business use of MQSeries.

Price Structure: The required number of Capacity Unit Resource Use Authorizations are defined by processor numbers within each machine or SP node.

Minimum entitlement to use an Intel (or equivalent) uniprocessor machine is included in the licensed program packaging. Additional capacity units can be acquired separately. For MQSeries use in environments other than an Intel (or equivalent) uniprocessor platform, additional capacity units must be acquired alongside the program package license.

  • If the customer environment for MQSeries consists of a single uniprocessor Intel (or equivalent) machine then the Capacity Unit Resource Use Authorization as provided in the program package is all you need.
  • If the customer environment for MQSeries, consists of a single machine from a higher tier , then an appropriate number of Capacity Unit Use Authorizations are required in addition to the program package.
  • If the customer environment for MQSeries, consists of more than a single machine or SP node , then an appropriate number of extra Capacity Unit Use Authorizations are required to match the appropriate requirements.

Transferability: MQSeries generic capacity units are intended to be transferable across MQSeries platforms that appear in the same MQSeries Transfer Group. The MQSeries Transfer Group will generally, but not exclusively, define MQSeries products at a consistent version and release level.

The capacity units are not transferable between products in different MQSeries Transfer Groups or with products in the MQSeries Integrator Transfer Groups. In general, a chargeable upgrade path will be provided to enable existing Use-Authorization (capacity units) to be migrated to an MQSeries product at a functionally enhanced version or release level.

Capacity units are transferable within MQSeries Transfer Group A, within MQSeries Transfer Group B, and within MQSeries Transfer Group C, but not between the three groups.

Customer Responsibilities: The customer must provide the minimum hardware and software environments in which the licensed programs can operate.

The customer must identify the machines on which they will install MQSeries. The customer or program provider will identify the tier in which they fit, and then calculate the level of Capacity Unit Charge for the required Use Authorization.

Problem determination (PD) is a customer responsibility. PD is an assessment of whether a problem is caused by hardware or software. PD is complete only when the cause of the problem is identified. This assessment includes examination of available symptoms using the PD procedures documented in the product.

Problem source identification (PSI) is a customer responsibility. PSI begins when software is determined to be the source of the problem. PSI includes tracing the source of the program to a host system control program (SCP), an application program, or another source. Assisting the customer with PSI is an IBM service and support responsibility.

Direct Customer Support: Direct customer support is provided by (product platform) SupportLine. This fee service enhances customers' productivity by providing voice and electronic access into the IBM support organization. (Product platform) SupportLine will help answer questions pertaining to usage, and suspected software defects for eligible products.

Security, Auditability, and Control

The announced program uses the security and auditability features of the workstation operating system.

In addition, MQSeries implements a level of security including access control of queues and authorization identification between message queue managers.

The customer is responsible for evaluation, selection, and implementation of security features, administrative procedures, and appropriate controls in application systems and communication facilities.

Ordering Information

MQSeries products use a flexible pricing structure. The new pricing structure simplifies the development and management of complex applications, particularly for large organizations.

There is only one charge unit for these products, the capacity unit.

The price model is structured over tiers that are defined by machine type and numbers of processors. The greater the number of processors per machine, the higher the tier position and the more Use Authorizations needed to use the program. This applies to each machine and machine upgrade. A two pack Capacity Unit Use Authorization is included with the program package (minimum entitlement for PC type product). Further capacity units can be acquired separately.

Expedite shipments will be processed to receive 72-hour delivery from the time IBM Software Delivery Solutions (SDS) receives the order. SDS will then ship the order via overnight air transportation.

System Program Order (SPO) (5692-AIX): A 5692-AIX SPO is mandatory for shipments of program distribution and publications. The individual licensed program orders (for example, XXXX-XXX) are for registration and billing purposes only. No shipment occurs under these orders.

To receive shipment of machine-readable materials stacked on a single 8-mm, 4-mm, or 1/4-inch tape, or CD-ROM requires an SPO (5692-AIX). Billing for the media type selected is generated under the SPO. To prevent additional billing expenses, place only one SPO order per machine.

Candle Command Center Admin Pac License Agreement

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE OPENING THE PACKAGE OR DOWNLOADING, INSTALLING OR USING THE SOFTWARE. DOING THESE THINGS INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PROMPTLY EITHER RETURN THIS PACKAGE UNOPENED TO YOUR SUPPLIER, OR HALT THE DOWNLOAD PROCESS.

  1. License. In this license agreement ("License Agreement"), Candle Corporation ("Candle") grants you, the purchaser of the license rights granted by this agreement ("You"), a non-exclusive, non-transferable, limited term license to use one machine readable object code copy of the accompanying software ("Software") and one copy of the included documentation ("Documentation") for the License Period indicated below (i) for your own internal use and benefit only, (ii) by a single user, and (iii) not for providing data processing services to third parties. This License Agreement, the Software and the Documentation and any copies, modifications, updates or fixes are referred to as the "Licensed Product". If the Licensed Product has been supplied as part of a packaged offering together with another product or products, You are hereby granted the same number of licenses to use the Licensed Product as the number of licenses which you acquired to use the other products with which it is supplied. If You have obtained multiple licenses to the Licensed Product, the terms of this Agreement apply to each license. For each license You obtain to the Licensed Product, You may make a reasonable number of copies for the purpose of backup. You may not otherwise copy or modify the Licensed Product. You may not release the results of any performance or functional evaluation or benchmarking of the Licensed Product to any third party without prior written approval of Candle for each such release.

    Some or all components of the Licensed Product may be activated through the use of an Activation Key. Refer to the "readme" file accompanying the Licensed Product for activation instructions and information.

  2. Title. All rights to and in the Licensed Product, including but not limited to patents, copyrights and trade secrets rights belong to Candle and Candle holds title to each copy of the Licensed Product.
  3. Nondisclosure. You shall not disclose, transfer or distribute the Licensed Product to others, and this Agreement shall automatically terminate in the event of such disclosure, transfer or distribution. Such prohibition on disclosure shall not apply to disclosures by You to your agents, contractors or employees provided (i) such disclosures are reasonably necessary to your authorized use of the Licensed Product and (ii) You take reasonable steps to ensure that the Licensed Product is not disclosed by Your agents, contractors or employees in contravention of this Agreement. You shall not reverse assemble or reverse compile the Licensed Product or in any way attempt to obtain the source code for the Licensed Product, and this Agreement shall automatically terminate in the event of such action or attempted action.
  4. Term and Termination. This License Agreement is effective for a License Period (from the date of installation to February 15, 2001), unless earlier terminated. Your license will terminate at the end of the License Period, and some or all components of the Licensed Product may cease functioning. Candle may terminate this License Agreement at any time if You breach any of the terms and conditions. Upon termination for any reason, You shall either return the Licensed Product to Candle or delete or destroy all copies of the Licensed Product and certify such in writing to Candle. All provisions of this License Agreement relating to disclaimers of warranties, limitation of liability, remedies or damages, and Candle's proprietary rights shall survive termination of this Agreement for any reason.
  5. Exclusion of Warranty. YOU AGREE THAT CANDLE IS PROVIDING THE LICENSED PRODUCT TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE LICENSED PRODUCT IS WITH YOU, AND YOU AGREE TO HOLD CANDLE HARMLESS AGAINST ANY AND ALL RELATED CLAIMS. IN ADDITION, ANY OTHER SOFTWARE AND ANY OTHER HARDWARE FURNISHED WITH OR ACCOMPANYING THE LICENSED PRODUCT IS NOT WARRANTED BY CANDLE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON THE LENGTH OF AN IMPLIED WARRANTY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIED RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.
  6. Limitation of Liability. IN NO EVENT WILL CANDLE BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, INCLUDING WITHOUT LIMITATION, ANY LOSS OF DATA OR LOSS OF PROFITS, OR LOST SAVINGS, ARISING OUT OF THE USE, OR INABILITY TO USE THE SOFTWARE OR DOCUMENTATION EVEN IF CANDLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY ANY THIRD PARTY. IN NO EVENT SHALL CANDLE BE LIABLE FOR ANY DAMAGES BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
  7. Restricted Rights. Where the United States Government or any agency thereof is a License or end user hereunder, the following additional terms apply: The Licensed Product is provided with RESTRICTED RIGHTS. Use, duplication or disclosure by the Government is subject to restrictions set herein and/or by Government Rights in Data Clause(s), as applicable (including but not limited to DFARS 252.227-7013(c)(ii) and FAR 52.227-19(a)-(d)).   8. Export Control. You agree to comply with all export and re-export restrictions and regulations imposed by the government of the United States and the government of the country in which the Product(s) are licensed, if different from the United States. You further agree that the Licensed Product shall not be exported or re-exported; (i) to any countries included in prohibited Country Groups of the U.S. Export Administration Regulations, (ii) as prohibited under such Regulations at the time of export or re-export, (iii) or delivered to national citizens of such prohibited Country Groups or (iv) in violation of this Agreement. Candle may terminate this Agreement in the event that its continuance or You are in violation of U.S. export regulations or related laws. This section shall survive termination, expiration or cancellation of this Agreement or any license hereunder.
  9. General. Any attempt to sublicense, assign or transfer any of the rights, duties, or obligations hereunder is void. This License Agreement shall be governed and interpreted under the laws of the State of California, United States of America, without regard to conflicts of law provisions, and excluding the United Nations Convention for Contracts for the International Sale of Good. The Licensed Product may include object code licensed to Candle by a third party which is a direct and intended beneficiary of this Agreement and may enforce it directly against Licensee. You are only granted the right to use the run-time version of such object code. The Licensed Product is not intended for use in online control of aircraft, air traffic, aircraft navigation, aircraft communications, rocket or ballistic missile systems or space vehicles, in the design, construction, operations or maintenance of any nuclear or chemical processing facility, or related in any way to chemical or biological weapons, missiles, or explosives, and You warrant you will not use the Licensed Product for such purposes.
  10. Country Specific Legal Terms. The following terms apply only to Software and Licensed Products that are licensed for use in the referenced country, where the referenced country is also the Governing Law.

    Australia. To the maximum extent permitted by applicable law, subject to sections 5 and 6 and any provision of this Agreement, the limited warranties given by Candle herein are exclusive and are in lieu of all other warranties and conditions whatsoever, whether express, implied or statutory. Notwithstanding any other provision herein, if anything arising out of or connected with this Agreement constitutes a supply of goods or services to a consumer, then You may have the benefit of certain rights or remedies pursuant to the Trade Practices Act and similar state and territory laws in Australia, in respect of which liability may not be excluded or restricted and nothing in this Agreement will have the effect of so excluding or restricting those rights or remedies. Insofar as such liability may not be excluded, then to the maximum extent permitted by law such liability is limited, at Candle's exclusive option, to either replacement of the Licensed Product or correction of defects in the Licensed Product. Nothing in this Agreement is intended to prejudice, or have the effect of prejudicing any rights Candle may have under Australian law or of the States of Australia which cannot legally be excluded or restricted and the terms of this Agreement must be read accordingly.

    Austria, Germany and Switzerland. The limitations and exclusions specified in sections 5 and 6 in the Agreement will not apply to damages caused by Candle with intention or gross negligence. Candle is liable for assured characteristics.

    Indonesia. To the extent necessary to implement the termination provisions of this Agreement, each of the parties hereby waives any right or obligation, it or the other party may have under any applicable law or regulation, including without limitation Article 1266 of the Indonesian Civil Code, to request or obtain the approval, order, decision or judgment of any court to terminate this Agreement.

    Ireland. No statement in this Agreement shall affect the statutory right of consumers.

    Japan. In addition to Candle's express disclaimers of liability in the Agreement. Candle is not liable for damages which have arisen through special circumstances.

    New Zealand. Where products or services are not acquired for the purposes of a business as defined in the Consumer Guarantees Act 1993, the limitations of liability in this Agreement are subject to the limitations in that Act.

    United Kingdom. The limitation of liability in this Agreement will not apply to claims for death or personal injury or physical damage to Your tangible property caused by the negligence of Candle or to any breach of Candle's obligations implied by Section 12 of the Sales of Goods Act 1979 or Section 2 of the Supply of Goods and Services Act 1982.

YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS LICENSE AGREEMENT AND YOU AGREE TO BE BOUND BY ITS TERMS. YOU FURTHER AGREE THAT THIS LICENSE AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND CANDLE AND SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS RELATING TO THE SUBJECT MATTER OF THIS LICENSE AGREEMENT.

Upgrades: You can upgrade to the Candle Center Management Pac for MQSeries — fully functioning versions of the two Candle Command Center products with complete support of all three products, available from Candle.
