IBM Enhanced AIX Operating System Subscription is the exclusive method for receipt of software upgrades. For ordering, contact: Your IBM representative, an IBM Business Partner, or IBM Americas Call Centers at 800-IBM-CALL (Reference: RE001). OverviewSoftware Subscription for AIX® has been restructured to a new offering called IBM Enhanced AIX Operating System Subscription that enables a single site or worldwide enterprise customer to maintain software entitlement to current or future versions or releases of the AIX operating systems. The subscription offering has been enhanced to provide a 1- or 3-year prepay contract. An After-License ordering feature is also available that enables customers to order upgrades to the current releases or versions being marketed by IBM. To allow more customers to take advantage of the new IBM Enhanced AIX Operating System Subscription offering, the After-License feature will be priced equal to the Subscription/Renewal feature until December 31, 2002. The automatic renewal billing process has been replaced with one-time charge (OTC) billing for the contract periods. IBM Enhanced AIX Operating System Subscription replaces the IBM Software Subscription for AIX (5692-SSO) and stand-alone upgrades ordered under each licensed program. This new offering compliments the July 10, 2001, announcement of "Changes to Selected Distributed Software Products Acquired Through IBM or IBM Business Partners Who Remarket iSeries and pSeries." Terms and conditions between the offerings do differ in that maintenance is not included in the first year of the AIX license and customers wanting support need to acquire a SupportLine contract for the AIX operating systems. The AIX operating systems currently being marketed by IBM are the only products participating in the Enhanced AIX Operating System Subscription offering. DescriptionIBM Enhanced AIX Operating System Subscription is an optionally purchased 1-year or 3-year contract offering that enables you to maintain software product version and release currency for AIX at a predetermined cost. Under IBM Enhanced AIX Operating System Subscription, you can receive all software product version and release upgrades announced during the contract period. If you allow either the 1- or 3-year software subscription offering to expire without renewal, there is an after-license option to enable reinstatement in the IBM Enhanced AIX Operating System Subscription offering, on a product-by-product basis. Definition of Software Upgrade: An upgrade is either a new version (3.x.x to 4.x.x) or a new release (x.3.x to x.4.x) of an IBM program announced as eligible for which you enrolled under the IBM Enhanced AIX Operating System Subscription. Upgrades do not include programs sold separately from the enrolled program, but that enhance the performance of that program, or are considered add-ons or utilities. Programs that perform the same functions as the enrolled program but are installed on a non-AIX platform are not considered upgrades. Note: Software preventative maintenance releases x.x.1 to x.x.2 (modification level changes, updates, or refreshes) are released under the 1-year or 3-year subscription program numbers but only when a supply feature has been announced. Supply features are only announced under the 1-year and 3-year options when there is an announced version/release change against the original program product. No-charge preventative maintenance releases should be obtained by Software Subscription customers in the same manner as non-Software Subscription customers. Example: Product A is offered under IBM Enhanced AIX Operating System Subscription and three months later maintenance updates (PTFs) are incorporated into the program package. This is considered an update that would not be obtained under the 1-year or 3-year subscription program numbers under the IBM Enhanced AIX Operating System Subscription offering. Using the same example above, three months after the PTFs were incorporated into the program package, IBM announces a new version of product A. At that time, a supply feature is announced for product A under the 1-year and 3-year subscription program numbers. This allows customers who are entitled by purchase of either the 1-year or 3-year subscription offering for product A to order the upgrade under the 1-year or 3-year offering. IBM may announce a product that can be substituted for an enrolled product. This product is neither a new version, a new release, nor a maintenance release of that enrolled product. In most cases, this product has a different architecture, more function, and a higher license charge than the enrolled product. IBM may provide those customers enrolled in the IBM Enhanced AIX Operating System Subscription offering access to this product at a discounted rate. The terms of this transaction will be included in the new product announcement. Note: IBM will not offer stand-alone upgrades as a standard product offering. Contract Duration: The IBM Enhanced AIX Operating System Subscription contracts are on a product-by-product basis and are offered for 1 or 3 years. The 1-year or 3-year prepay option can be purchased at the same time a license for an eligible AIX operating system is acquired. Refunds do not apply if cancellation occurs during 1- or 3-year contract period. Customers are not required to renew under either the 1- or 3-year offering when the contract expires but will need to use the after-license option should they let the contract expire and want to acquire a new version or release of an eligible AIX operating system. If the 1- or 3-year contracts are not renewed, the 1- or 3-year contracts will be removed from IBM administrative systems. Contract transfers within an enterprise are allowed. Payment Options: Customers enroll in the plan at a reduced Initial price at the same time a new license for an AIX operating system is acquired. Customers can also enroll in the plan after acquisition of a new license for an AIX operating system through the purchase of an after-license option. IBM Enhanced AIX Operating System Subscription Prices: The IBM Enhanced AIX Operating System Subscription program prices for all versions and releases of AIX are based on "processor capability" purchased and activated. Example: If a customer has a pSeries system with a 6-way CUoD processor (6 of 12 processors active), the customer would purchase 6 AIX Enhanced Subscription licenses. Notification of Upgrade Availability and Ordering: Customers should register to receive e-mail notifications when Enhanced AIX Operating System Subscription products are upgraded. Adding New Licenses to an Existing Contract
New software licenses cannot be added to an existing Enhanced AIX
Operating System Subscription contract. No proration is allowed. As new
AIX operating system licenses are added, a new AIX Operating System
Subscription contract should be ordered for those licenses.
Adding Previously Installed Licenses to an Existing Contract
You cannot add installed product licenses to a contract that were not
initially covered by an existing contract. These licenses should be
added using the after-license feature under a new and separate AIX
Operating System Subscription contract. The protection expires when the
originally dated AIX Operating System Subscription contract is not
renewed.

Software Upgrades for Customers with Active IBM Software Subscription for AIX (5692-SSO) Contracts
Transition from Existing Software Subscription for AIX OfferingUntil April 8, 2002, as existing contracts for IBM Software Subscription for AIX (5692-SSO), under which you purchased software subscription for the AIX operating systems, become eligible for renewal, you are encouraged to move to the new Enhanced AIX Operating System Subscription offering. You will be allowed to move to the new offering by ordering the Subscription/Renewal feature versus the After-License feature. However, if required, you can renew your existing Software Subscription for AIX offering contract up to one additional year. After April 8, 2002, as existing contracts for IBM Software Subscription for AIX (5692-SSO), under which you purchased software subscription for the AIX operating systems, become eligible for renewal, if you want to continue with subscription for the AIX operating systems, you must move to the new Enhanced AIX Operating System Subscription offering. You will be allowed to move to the new offering by ordering the Subscription/Renewal feature versus the After-License feature. To allow you to take advantage of the new IBM Enhanced AIX Operating System Subscription offering, the After-License feature will be priced equal to the Subscription/Renewal feature until December 31, 2002. Security, Auditability, and ControlRefer to the original or revised AIX operating system announcement letter for the unique AIX operating system offered under the IBM Enhanced AIX Operating System Subscription offering. The customer is responsible for evaluation, selection, and implementation of security features, administrative procedures, and appropriate controls in application systems and communication facilities. Ordering InformationAIX RS/6000® and pSeries brands are restructuring their existing subscription offering, IBM Software Subscription for AIX (5692-SSO). This enhanced subscription offering is called "IBM Enhanced AIX Operating System Subscription" which offers customers either a 1-year or a 3-year OTC subscription to the program. A customer ordering a new license for one of the operating system licensed products below should include a 1-year or a 3-year subscription order to be entitled to version or release upgrades of the licensed program. Customers, who choose not to order the Enhanced AIX Operating System Subscription at the time of initial acquisition of the AIX license will receive the lowest price. Customers, who decide at a later date to purchase this option, will need to enter the program with an "after-license" charge.
